CIVIL AND LEGAL REGULATION OF RELATIONS IN THE FIELD OF PROFESSIONAL SPORTS DURING MARTIAL LAW

Abstract

The article examines the issue of civil-law regulation of relations in the field of professional sports during the period of martial law, which suffers from ambiguity in the legal regulation of relevant relations in this period of time. It was determined that to date, the problems of legal regulation of relations in the field of professional sports in the conditions of crisis phenomena caused by a full-scale invasion have not been studied by domestic researchers due to the lack of publicity in decision-making at the level of national sports federations, which determines the relevance of similar studies. It was noted that in order to achieve the goals of the study, it is important to have a correct understanding of the grounds and procedural aspects of making changes to the terms of contracts in the field of professional sports. It is noted that one of the tasks of civil law regulation is the stability of contractual legal relations, while a significant change in the circumstances that the parties were guided by during the conclusion of the contract acquires a special risk significance during the execution of the contract, which can lead to an imbalance in the obligations of the parties to the contract. It has been clarified that the interests of the parties to a civil law contract may be violated by any change in circumstances that occurs during the execution of the contract, however, only a significant change in circumstances is recognized as a basis for filing a claim to change the terms of the contract. It was determined that in the event of a significant change in circumstances under the civil legislation of Ukraine, proper performance of the contract is possible, but significantly complicated. A significant change in circumstances can be qualified as a type of force majeure circumstances. It was concluded that the issues of civil law regulation of relations in the field of professional sports during the period of martial law remain relevant for scientific development with the aim of further improving the regulatory framework and specifying the general norms of civil legislation regarding the fulfillment of obligations under professional contracts in the field of sports and achieving a balance of public and private interests in relations in the field of professional sports.
